A positive drug test in the military can ruin your career. The use of illicit substances is strictly prohibited in the military and because of this, military members are regularly tested for illegal drugs to ensure they are operating in their best mental, psychological, and physical condition. Consequently, the military service is the only jurisdiction in the United States mandated to punish drug cases tested on a urinalysis test. It’s known as the zero-tolerance policy.

As a service member, testing positive for a military drug test is serious, but it does not mean your career is over. The military defense attorneys at Golden Law Inc. want you to know that you are well within your rights to defend yourself, and they want to help you do just that.

Our experienced military defense attorneys can help protect your career, reputation, and future.

Questions to Ask if Drug Test Comes Back Positive

If you have been asked to provide a urine sample for testing and the results come back positive, there are several parts of the process that can be questioned. We will ask the following questions to best defend your case:

  • Which method was used to collect the urine sample?
  • What lab procedures were used to test the urine sample?
  • How was the urine sample handled, protected, or stored during testing?
  • How accurate were the forensic procedures used to test the urine?
  • Could it be that the drug in question was ingested innocently or unknowingly?
  • Which combination of drugs or medications could trigger positive in false-positive results?

Drugs That May Lead to False Positive Results

A military screening is conducted to detect illegal drugs, such as marijuana, cocaine, methamphetamines, and amphetamines in urine samples. However, the presence of certain drugs in the body can lead to false-positive results. Some of the drugs that can trigger false-positive results include:

  • Antibiotics
  • Antidepressants
  • Antipsychotics
  • Antihistamines
  • Analgesics
  • Decongestants
  • And some types of over-the-counter medications

Since these drugs could generate false-positive results, it helps to use a secondary test like GC-MS to determine the specific compounds causing the false-positive result. Other drugs that can produce positive results include diet pills, bupropion, coca leaf tea, hemp oil, venlafaxine, and ibuprofen.

These drugs are legal and often used for medical reasons, so it is unfair for your reputation and career to be threatened due to these drugs generating false-positive results.
